General
The first
In order to promote the development of public libraries, meet the public's demand for knowledge, information and related cultural activities, realize and protect the basic cultural rights and interests of the public, this Regulation is formulated in accordance with relevant laws, regulations and the actual conditions of this Municipality.
Article 2
This Regulation shall apply to the establishment, management and service of public libraries within the administrative area of this Municipality.
Article 3
The term "public library" as mentioned in the present Regulations refers to a public welfare service organization established by people's governments at various levels and open to the public. It collects, organizes, preserves, researches, and makes use of documentary information resources.
The aforementioned literature information resources referred to in the preceding paragraph include books, newspapers, periodicals, microfilm products, audiovisual products, electronic publications, and digital resources.
Article 4
The municipal department of cultural administration shall be responsible for the administration of public library undertakings in the whole city, and organize the implementation of these Regulations.
The administrative department of cultural affairs in the district is responsible for the management of public library undertakings within its administrative area.
The administrative departments of development and reform, finance, education, planning, land, human resources, construction, transportation, etc. shall coordinate the implementation of these regulations in accordance with their respective duties.

The municipal and district people's governments shall incorporate the public library undertakings into the national economic and social development plans and annual plans, and the required funds shall be included in the budget of this level, so that the financial input and economic and social development and the service population and service scope of public libraries Service requirements, service functions, etc. adapt.
Public library funds include fees for facilities, equipment, personnel, documentation and information resources, and library operations and maintenance.
Article 6
Encourage domestic and foreign natural persons, legal persons or other organizations to support the development of public libraries by donating funds, documents, facilities, equipment, or other forms.
Encourage and support domestic and foreign natural persons, legal persons, or other organizations to develop office libraries, and provide or provide public welfare reading services in cooperation with public libraries. People's governments at various levels shall provide support in accordance with relevant laws and regulations.
If natural persons, legal persons or other organizations at home and abroad participate in library construction or provide public welfare reading services in the manner prescribed in the first and second paragraphs of this article, they are entitled to preferential treatment such as taxation in accordance with relevant laws and regulations. Article 7
The municipal and district people's governments may initiate the establishment of public libraries to develop social funds.
Encourage domestic and foreign natural persons, legal persons or other organizations to establish social funds for the development of public libraries according to law, or to develop social funds for donations to public libraries.
The establishment, operation and management of social funds for the development of public libraries shall be implemented in accordance with the provisions of relevant laws and regulations.

The municipal and district people's governments shall promote the establishment and operation of public libraries for corporate governance mechanisms, and establish and improve corporate governance institutions such as the council. Article 9
Every year in April is the reading month in Guangzhou.
Administrative departments and units such as cultural administrative departments and public libraries shall organize and carry out popular reading promotion activities in various forms.
The establishment of a public library
Article 10
The municipal and district people's governments shall, based on the social, economic and cultural development of the region and the distribution of the population, make overall planning and rational distribution, and establish a public library system covering urban and rural areas.
The municipal department of cultural administration shall compile public library construction plans according to the national economic and social development plan, the overall city plan, and the overall plan for land utilization. After being reviewed by the city's development and reform, planning, and land and administrative departments, the Municipality shall report to the municipal people's government for approval.
Article 11
The location of the public library should be located in an area where the population is relatively concentrated, the transportation is convenient, and the municipal facilities are well-supported. It meets the requirements for safety, hygiene, environmental protection standards and reasonable service radius.
If the location of a public library that has been completed or has started construction before the implementation of these Regulations does not conform to the provisions of the preceding paragraph, the municipal and district people's governments shall gradually improve the supporting public transport and municipal facilities of the public library, and improve the public library according to relevant standards. Article 12
The municipal and district people's governments shall establish their own public libraries.
The Guangzhou Library established by the Municipal People's Government is the central hall of the city's public libraries. The Center Hall can establish directly-affiliated branch libraries or specialized branch libraries according to the public library development plan and actual needs.
The district people's government is responsible for the construction of district, town, and street public libraries and the establishment of a general branch library system for public libraries. The district public libraries are regional headquarters, and town and street public libraries are branch offices. There may be no branches in the towns and streets where the provincial, municipal and district public libraries are located.
Article 13
The district people's government shall promote the construction of libraries and service outlets in villages and communities according to local conditions, and may set up library rooms or service outlets in densely populated areas such as schools, enterprises, subway stations, railway stations, bus stations, and airports.
The relevant units shall provide necessary support for the establishment of library rooms or service outlets in the fields, supporting facilities and equipment, etc., according to actual conditions.
Article 14
The Municipal People's Government shall set up a juvenile and children's library. District People's Government can set up a children's library. The juvenile and children's library set up by the municipal and district people's governments is a specialized branch of the central hall and regional headquarters.
The center hall and the regional general hall should set up a reading area for children.
Article 15
The center hall and the regional hall should be built independently. Towns, sub-branches, or villages and community libraries can be co-built with other cultural facilities, or use other existing building construction.
Where a public library (room) is co-built with other cultural facilities, it shall satisfy the library's (room) use function and environmental requirements, and be self-contained with a separate entrance and exit.
Article 16
The building area of the public library is determined by the number of permanent residents within the service area and due consideration of population growth factors. The construction area per 1,000 people in a public library shall meet the following requirements:
(1) The municipal public library reaches more than ten square meters;
(2) The total number of regional centers, towns, and sub-branches reached 37.5 square meters, but the area where the provincial and municipal public libraries are located may be lower than the above standards.
The construction area of public libraries in cities and districts, and branches in towns and streets shall not be lower than the national minimum standards.
The area of the library for children and teenagers in the public library should not be less than 20% of the area of the library's lending service area.
Article 17
The total collection of books in public libraries should be higher than the national standards. Based on the resident population in the service area of public libraries, the per capita possession of the collection of paper information resources by 2020 should meet the following requirements:
(1) A total of one or more municipal public libraries can be reached;
(2) The total number of regional headquarters, towns, and sub-branches reached two volumes or more.
Article 18
Public libraries should constantly improve and enrich library information resources. The construction of literature and information resources should take into account the paper information resources, digital information resources and other information resources to meet the needs of the service population.
Based on the resident population in the service area of the public library, the per capita collection of paper information resources in the public library should meet the following requirements:
(1) No less than 0.06 volumes (pieces) of municipal public libraries;
(2) The total number of regional headquarters, towns and sub-districts combined shall not be less than 0.14 (pieces).
Article 19
Public libraries should strengthen the co-construction and sharing of digital information resources. The Central Pavilion shall establish a unified general digital information resource pool in the city, integrate digital information resources with traditional carrier resources, and provide digital and networked services for users of public libraries in the city; the regional headquarters can build digital information with local content of specific characteristics. In the construction of digital information resources, attention should be paid to the application of information technology. According to the use of digital information resources, the corresponding processing level and preservation period should be determined, and excellent cultural heritage should be preserved for a long time.
The Center Hall and the Regional General Hall should establish a complete digital information resource management platform to realize the scientific management of digital information resources, strengthen the protection of intellectual property rights, and ensure the legal use of digital information resources.
Article 20
Public libraries should strengthen the collection, sorting, and protection of local documents, and gradually establish collection systems or special series with complete data, complete systems, and local characteristics.
Article 21
No unit or individual may dismantle the public library (room) without authorization or change its function and use.
If it is legally approved to demolish a public library (room) or change its functions and uses, it shall be rebuilt or relocated on the original site in accordance with the provisions of relevant laws, regulations and these regulations. Public libraries (rooms) reconstructed or relocated on the original site shall meet the planning requirements and shall not be smaller than the original scale. The relocation of the public library (room) should be completed after the new hall (room) is completed.
Article 22
The city's public libraries implement unified signs and incorporate city signage systems such as road signs, road signs, and public transportation.

Article 23
The municipal and district people's governments shall, according to the criteria for serving a permanent population of 10,000 to 15,000 staff members, combine the service hours, the size of the buildings, the number of collection resources, and the amount of user services, and reasonably allocate corresponding quantities. New management personnel and professional and technical personnel of public libraries shall have a bachelor degree or above and professional knowledge and skills that are compatible with their positions, and shall implement open recruitment in accordance with relevant regulations. Public libraries should establish and improve their staff business training and continuing education system in accordance with the development of library undertakings and business requirements.
Article 24
The public library implements the director responsibility system.
The director of a municipal public library shall have the appropriate professional senior professional technical titles or the corresponding professional senior professional titles with more than five years of library work experience.
The director of the regional general hall should have a corresponding professional professional title of a senior professional or above, or a professional intermediate professional title with a professional work experience of more than three years.
Article 25
The center hall should perform the following duties:
(1) Responsible for the guidance and coordination of the city's public library business;
(2) Responsible for formulating and organizing the implementation of uniform business standards and service standards for public libraries in the city;
(3) Responsible for coordinating the construction of the public library loan service network, information management system and digital library in the city's public libraries;
(4) Responsible for organizing professional training for the staff of public libraries in the city;
(5) To carry out domestic and foreign exchanges and cooperation in the field of libraries.
Article 26
The regional headquarters performs the following duties under the guidance of the center's business:
(1) Responsible for the unified management of its sub-branches;
(2) Responsible for the procurement, cataloging and logistics distribution of the literature and information resources of the Library and its sub-branches in accordance with the unified business standards of the city;
(3) To formulate service standards for public libraries (offices) and service outlets in the district in accordance with the unified service standards of the city;
(4) To be responsible for the overall deployment of the staff of the Library and its sub-branches;
(5) To carry out domestic and foreign exchanges and cooperation in the field of libraries.
Article 27
Public libraries should improve the utilization of paper information resources in library space and collections, regularly check the collection of paper information resources, and use paper-based information resources that have valuable value but have a relatively low utilization rate. To deploy and use, or to establish a storage library for collection; the collection of paper information resources that cannot be used for reasons such as severe damage or obsolescence can be removed according to relevant procedures.
The public library shall formulate rules for rejecting paper information resources that are compatible with the development needs of the library's collections and submit it to the competent administrative department of culture for approval.
Article 28
The public library should do a good job in the preservation and protection of document information resources, and be equipped with necessary facilities such as fire prevention, anti-theft, moisture prevention, pest prevention, disinfection, disaster recovery, and other necessary facilities, establish emergency plans, and implement relevant safety management systems.
Article 29
Public libraries should abide by the laws and regulations of national intellectual property protection and protect and rationally use the literature information resources according to law.
Article 30
Books, newspapers, periodicals, audio-visual products, miniature products, electronic publications, etc. published by the publishing unit legally registered in this Municipality shall submit two volumes (pieces) to the Guangzhou Library within 60 days from the date of publication; Children's and children's publications should submit two volumes (pieces) at the same time to the Guangzhou Children's Library.
The internal information publications edited by the people's governments at various levels and their functional departments shall, within 60 days from the date of preparation, submit four volumes (pieces) of information to the public libraries at the corresponding level for preservation.
Natural persons, legal persons, or other organizations are encouraged to donate various publications and materials published or printed to public libraries through various means.
The public libraries that have been paid or donated shall present the acceptance or donation vouchers to the publishing and editing units, and regularly compile and submit the catalogue of contributions and donations to the public.
Article 31
Public libraries should establish a consultation system for the procurement of literature and information resources, and widely solicit opinions from users, experts, and relevant industry organizations on the types and quantities of document information resources purchased.
Article 32
The municipal department of cultural administration shall formulate assessment standards for public libraries and establish a third-party evaluation mechanism.
The municipal, district administrative department of culture shall regularly review the establishment, management and service of public libraries.
Article 33
Encourage the establishment of library industry organizations, support industry organizations to play the role of industry self-regulation, industry representatives, industry services, industry guidance and industry coordination.
The responsibilities and rules of procedure of library industry organizations are regulated by their statutes.
Public Library Services
Article 34
Public libraries should adhere to the principle of universal, equal, free, open, and convenient service.
Article 35
Public libraries should provide the public with the following basic services:
(1) Services such as reading, loaning, inquiring, and consulting services of literature information resources;
(2) Government public information inquiry services;
(3) To carry out popular reading promotion activities and information literacy education, and to hold social education activities such as public lectures, exhibitions, and training to provide conditions and support for lifelong learning for the public;
(4) Spaces and platforms for providing learning, exchanges and related public cultural activities;
(5) Other basic services.
Article 36
In addition to providing basic services in accordance with Article 35 of these Regulations, public libraries shall also provide the following services in accordance with their own operational capabilities:
(1) Providing thematic information services to the public;
(2) Providing information services for the decision-making of state organs;
(3) To provide services for carrying out research on local documents and local history and culture.
Article 37
Public libraries should use information technologies and carriers such as the Internet and mobile phones to provide users with services such as remote inquiries and reading, as well as personalized information services.
Public libraries should use the computer management and bibliographic search systems to publish catalogues of collections of paper, electronics, and microfilm collections to the public and provide basic search methods such as titles, authors, and themes to facilitate user inquiries.
Public libraries should provide users with the necessary digital service space and facilities and equipment.
Article 38
The regional headquarters shall, according to the age structure, education level, and employment status of villages and community residents, appropriately allocate the literature and information resources of the village and community library, improve the reading environment, and improve the service level.
Public libraries should, through forms of mobile stations, mobile vehicles, or self-service libraries, provide fixed-point and regular-time information and resources in villages, communities, and other grass-roots organizations and units to borrow and return services and other public library services.
Article 39
Public libraries should advocate and promote reading for the general public and key children and young people in the form of recommending excellent books, organizing reading clubs, and conducting reading and counseling.
Article 40
The Center Hall, the Regional General Hall and its branch offices shall realize the borrowing and return of document information resources by 2020.
Article 41
Public libraries providing basic services should be free.
The public library provides services such as document copying, text printing, instant payment database search, scientific search, special information service, and literature information resource development, and may charge appropriate fees. Charge items and standards shall be submitted by the competent administrative department of culture to the price administrative department in accordance with the "Price Law of the People's Republic of China". Public library fees should be used for the construction and management of public libraries.
Public libraries must not provide venues for third parties to host commercial activities unrelated to the functions and services of public libraries. The consent of the public library to organize related activities shall not affect the normal use of public libraries by users.
Article 42
The opening hours of the Central Library are not less than 70 hours per week, the opening hours of the Regional Library are not less than 63 hours per week, and the opening hours of the Town and Street Branches are not less than 40 hours per week.
The opening hours of the Children’s Library are not less than 48 hours per week. During the school’s winter vacations, the opening hours should be extended each day.
On national legal holidays, public libraries can adjust opening hours according to actual conditions.
Article 43
The public library should publicize the service scope, service guide, opening hours, charging items and standards of the library at the entrance of the library and in a prominent position in the museum. The central library and the regional museum should also be publicized on its website.
Any change in opening hours or closure due to any reason shall be announced seven days in advance, except in cases of force majeure and accidents.
Article 44
Public library users have the following rights:
(1) Equal access to information and knowledge;
(2) Free and equal access to basic public library services;
(3) making suggestions and opinions to public libraries or cultural administrative authorities and obtaining timely responses;
(4) Obtaining other services provided by public libraries in accordance with relevant regulations.
Article 45
Users of public libraries should observe the following rules:
(1) Making reasonable use of public library resources according to law;
(2) Protecting the public library's documentation and information resources, facilities, and equipment and must not damage it;
(3) to properly keep and return the library documentation information resources borrowed according to the prescribed time limit;
(4) Submission to the management of public libraries and observance of public order. There shall be no disturbances in the public library, such as chasing slapsticks, loud noises, and affecting the behavior of other users;
(5) comply with other rules and regulations.
Article 46
Public libraries shall protect and use user information according to law and shall not disclose or disclose to users without authorization.
Article 47
Public libraries may not restrict the use of documentary information resources, except for state-proven documentation and information resources that are prohibited from being disseminated.
The ancient books and other valuable and vulnerable literature information resources shall be protected in accordance with the laws and regulations, and shall be protected by the use of digitized, cost-effective reengineering or microfilming techniques. For other documentary information resources that should not be borrowed, readers can read in the library.
Article 48
Public libraries should provide convenient services in the areas of facilities, equipment, and documentation and information resources for special groups such as the elderly and the disabled.
The Central Hall and the Regional General Hall shall set up a blind reading room and special seats for disabled persons.
Article 49
Public libraries should strengthen exchanges and cooperation with school libraries, scientific and professional libraries, and other types of libraries through the formation of library alliances or other means, through interlibrary loan, document transmission, joint reference consultation, and open digital resources. Library and other ways to achieve resource sharing and joint services.
Children's and Children's Libraries should promote cooperation with primary and secondary school libraries and provide services to primary and secondary school students through mobile stations and mobile vehicles.
School libraries, scientific and professional libraries, and other types of libraries are encouraged to assume public library functions or to participate in the establishment of public libraries (rooms) to provide public welfare services.
Article 50
Public libraries should establish a normalized voluntary service mechanism, strengthen cooperation with volunteer service organizations, and organize volunteers to participate in the daily operation and service of public libraries as needed.
Article 51
Public libraries can purchase services from social organizations and attract social organizations to participate in the operation and management of public libraries.
Public library purchase services should help improve service effectiveness.
Article 52
Public libraries should set up user suggestion boxes (books) at prominent locations in their buildings, publicly supervise telephone calls, open complaint channels on the Internet, organize social supervisors, and hold user forums on a regular basis.
The public library shall, within five working days from the date of receipt of the opinions or complaints, give feedback to the person or complainant who submitted the opinions or the handling of the situation.

Article 53
Where the competent cultural administration department and relevant administrative departments and their staff have any of the following acts, the higher administrative organ or relevant department shall order it to make corrections and report criticism; if the circumstances are serious, it shall be legally granted to the person directly in charge and other directly responsible personnel. (1) Violating the provisions of Article 10 of these Regulations, failing to formulate public library construction plans according to the regulations;
(2) violating the provisions of Article 21 of these Regulations, disassembling a public library (room) without authorization or changing its function or use, or failing to rebuild or relocate a public library (room) as prescribed;
(3) In violation of the provisions of Article 32 of these Regulations, no assessment criteria have been established, public libraries have not been regularly assessed, or no third-party assessment has been conducted;
(4) Other acts in violation of the provisions of these Regulations.
Article 54
Where a public library or its staff has one of the following acts, the competent department of cultural administration shall order it to make corrections within a time limit; where the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be dismissed by the dismissal authority or relevant department according to law:
(1) violating the provisions of Article 21 of the present Regulations, disassembling a public library (room) without authorization or changing its function, use, or reconstructing or relocating a public library (room) in accordance with the original site;
(2) In violation of the provisions of Article 28 of these Regulations, the preservation and protection of document information resources have not been completed as prescribed, resulting in the destruction or loss of documentary information resources;
(3) Violating the provisions of Article 29 of these Regulations and failing to protect and reasonably use literature and information resources in violation of intellectual property rights according to law;
(4) Violating the provisions of Article 43 of these Regulations and failing to publicize the relevant matters according to regulations;
(5) Violating the provisions of Article 46 of these Regulations, failing to protect and use user information according to law, or unauthorized disclosure or disclosure of user information;
(6) Violating the provisions of the first paragraph of Article 47 of these Regulations and arbitrarily restricting the use of documentary information resources;
(7) In violation of the provisions of Article 48 of these Regulations, it has not provided convenient services for special groups such as the elderly and the handicapped to provide facilities, equipment, documentation, and information resources;
(8) Other acts in violation of the provisions of these Regulations.
In the process of providing services, public libraries charge fees to the public in violation of regulations, and the price administrative department investigates and punishes them according to law.
Article 55
In violation of the provisions of Article 21 of these Regulations, natural persons, legal persons or other organizations at home and abroad dismantling public libraries (rooms) or changing their use functions and uses without permission, or failing to rebuild or relocate public libraries as prescribed If the room is), the cultural law enforcement agency shall order it to make correction within a time limit and may impose a fine of not less than 100,000 yuan but not more than 500,000 yuan.
Article 56
Where a publishing unit fails to submit a publication in accordance with the first paragraph of Article 30 of these Regulations, the Guangzhou Library or the Guangzhou Children's Library may notify the publishing unit to submit the deadline; if no payment is submitted, the municipal cultural law enforcement agency shall order corrections. Give a warning.
Article 57
If a user violates the provisions of Article 45(2) of these Regulations by destroying public library documentary information resources, facilities and equipment, it shall make compensation according to law; if it violates public security management regulations, the public security organ shall impose penalties for public security administration according to law.
If the user violates the provisions of Article 45(3) of these Regulations and fails to return the borrowed literature information resources within the time limit, the public library may collect the breach of contract in accordance with the terms of the service contract; the public library may not return the documents after a reasonable reminder. The public library can suspend the use rights of its readership certificate and record it into its personal credit history. Loss of borrowed literature information resources shall be compensated according to law.
If a user violates the provisions of Article 45, Items (4) and (5) of these Regulations, and does not comply with public order, interferes with or affects other users, or does not comply with other rules and regulations, public library staff have the right to Discourage and stop, if the circumstances are serious, they shall be persuaded to leave; in violation of public security management regulations, the public security organs shall impose penalties for public security administration according to law.
Supplementary Articles
This Regulation shall come into effect on May 1, 2015.
